What is Collaborative Divorce

Collaborative divorce is a way for couples to divorce without court involvement. It’s a cooperative process — not adversarial — in which each spouse in the divorce is represented by his or her own attorney, but both parties agree to focus their efforts on reaching an amicable settlement.

While in traditional divorce litigation, spouses are often trying to be the “winner” with the other spouse “losing” things like property or custody, the goal of collaborative divorce is a “win/win” outcome — where each party gets what he or she needs to move forward from the marriage.
